should this be illegal?

rami asked:

recently, there was a local news story about a woman who was arrested for “threatening defecation.”

A woman was over at a friend’s home for dinner. She felt the urge to heed nature’s call and asked to use the restroom. Her host refused, saying that she had just had the bathrooms cleaned at great expense and did not want them contaminated by her friend’s excretions. The guest insisted she be allowed to proceed or her host “would be sorry.” The host felt sufficiently threatened that she called 911 and police were over in a matter of minutes. The guest was escorted from the premises and taken into custody, but charges were never filed.

Who do you think was in the right?

No but it seems like she was simply removed from the house. With a friend like that she sure doesn’t need enemies..

The host definently should have let her ure the restroom. After all he was probely going to “contaminate” it anyway.

so, that towns taxpayers had to pay for the cops to take a trip, for this? I’d be taking the host to court, so she could pay the town back! As the guest, what kind of people are you hanging out with ? Nutjobs….

Wow!

With friends like that what could she expect from strangers/enemies!

In my opinion, her ‘friend’ is a ‘pinhead’!

No friend would refuse a friend the bathroom. This story stinks.

This story is not true.

It would have been a landmark case. Everyone would have known about it.

As it is, I had heard this story before and understand from friends, family and other connections in various law enforcement agencies and private investigative venues that it first appeared in 1967 and has been periodically reinvented and recirculated ever since..

What IS true is that any action such as this woman allegedly committed would make her guilty of certain misdemeanors, such as criminal trespass, disorderly conduct, verbal assault, . . . and potentially a variety of felonies, including menacing.

The use of bodily secretions as a weapon has been considered assault with a deadly weapon in many court trials.

This sounds like a case for Jerry Springer.

It should be illegal to stop someone from using your bathroom if they’re a guest.

#16 erok4444 on 02.13.10 at 4:29 am

The host certainly doesn’t sound like a “friend.”

#17 George_D_ on 02.13.10 at 4:33 am

“Right” legally, or “right” ethically? Legally, the host, although this person certainly wasn’t humane, much less a friend. Aside from that, all favor falls to the guest.

I think She was wrong. She should have taken a dump before the police got there.

Real story or not, it’s still better than the usual stuff.

#19 Shovel_Ready on 02.13.10 at 4:38 am

Whenever I need to take a dump, I always wrangle a dinner invitation out of someone, so I can kill two birds with one stone. I would hate to see the government interfere with my lifestyle. I usually take a shower while I am there as well.

Is this possibly really true? I mean what did the owner of the newly cleaned potty do? Did she use the garden? I have heard that there are some people with mental problems that might raise objections to someone else using their bathroom, but they would have another facility for whatever friends they might have.

In the light of mental illness the police were correct in removing the guest from the situation, it could have escalated. I doubt the friendship will continue.
The owner revoked the guests status as guest, and the guest became a trespasser.
But, the owner is a full blown nutcase.

Since charges were never filed, its not illegal, should it be? I don’t think we need to make laws to cover such a rarity.

If someone is nice enough to let you into their house, that doesn’t entitle you to use their bed, their bath, or their toilet. The guest should have just left and found another place to defecate. There are plenty of businesses that have no customer restrooms. That isn’t a license to just poop on their floor out of spite. If the woman couldn’t hold it, she should be wearing diapers.

#22 Stony on 02.13.10 at 4:49 am

The guest should have left and reconsidered her friendship with the host, who is clearly a jackass.

#23 amy_lynn_ on 02.13.10 at 4:52 am

Illegal? No. It’s just mean to not let someone use the bathroom but that would be a ridiculous law with everything else that goes on in the world.

#24 John on 02.13.10 at 4:57 am

If this story is true, it is unlikely that charges will stick. This case will likely be thrown out of court.

The woman responded to a biological urge. One that sometimes can not be suppressed, depending on the circumstance.

I doubt the host can prove that the woman could hold her bowels, in the moment. It’s very plausible that she could NOT hold her bowels, at the time.

Being arrested and being CONVICTED are to separate issues.
